Minutes note: Jim Rice - Walker's Point Music Hall stated he sends 2-3 shows a week to Cudahy. Tony Edan 3143 N 76th St stated he is a musican who plays all ages shows around the country and there are not many options in Milwaukee. Ava Jessen 2887 S Baran St stated that she is a high school student in a band and there are not a lot of places for youth to perform. Johanna Rhodes 2401 N Vel Phillips Ave stated she is a touring musicians and having the ability to play all ages shows would be life changing. Tracey Gesser 2887 S Baran St stated this will provide opportunities for youth to perform and go see different performances. Kelsey Kaufman 814 S 9th St stated she runs the Cactus Club and they do approximately 10 all age shows per year.

Analysis

This ordinance establishes a fee structure based on capacity for centers for visual and performing arts. It further provides a requirement that all-ages performances are subject to curfew limitations for underage patrons.

 

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1.  Section 81-17.7 of the code is repealed and recreated to read:

 

81-17.7. Center for the Visual and Performing Arts.

1. Each center for the visual and performing arts license shall be issued and shall expire on the same date as the public entertainment premises license held by the same premises.

2. The fee for each license shall be based on the maximum capacity of the premises established by the common council under s. 108-7-3:

a. 25 or fewer persons, or a premises without a specified capacity: $150.

b. 26-79 persons: $250.

c. 80-99 persons: $375.

d. 100-149 persons: $500.

e. 150-179 persons: $700.

f. 180-299 persons: $1,000.

g. 300-499 persons: $1,500.

h. 500 or more persons: $2,000.

Part 2.  Section 90-37-3-0 of the code is amended to read:

 

90-37. Centers for the Visual and Performing Arts.

 

3. MINIMUM QUALIFICATIONS. No premise shall be licensed as a center for the visual and performing arts unless it fulfills all the relevant criteria of pars. a to [[c]] >>d<<.

 

Part 3.  Section 90-37-3-b-1 of the code is amended to read:

 

b-1. At least one stage [[larger than1,200 square feet in size]] >>or designated performance space<<.

 

Part 4.  Section 90-37-3-d of the code is created to read:

 

d. At a center for the visual and performing arts that provides live music performances on a stage or designated performance space less than 1200 square feet in size to an all-ages audience, which is subject to the curfew limitations set forth in s. 106-23 and the employment limitations of minors set forth in s. 103.78, Wis. Stats., underage patrons shall enter the premises no earlier than one hour before a scheduled performance and shall leave the premises no later than one half hour after completion of the performance.
