Analysis

This Resolution authorizes the City Attorney to serve and file an offer of judgment in the amount of $400,000 in the case of Sterling D. Brown v. City of Milwaukee, et al., Case No. 18-C-0922

 Body

Whereas, Sterling Brown has filed a lawsuit seeking an unspecified amount of damages arising from the conduct by Milwaukee police officers during an incident that occurred on January 26, 2018 in a pharmacy parking lot in the city of Milwaukee;

 

Whereas, prompt resolution of this lawsuit can result in the avoidance of attorneys’ fees and costs spent unnecessarily in the litigation of the matter,

 

Whereas, the plaintiff, Sterling Brown, through his attorneys and the City of Milwaukee, through the City Attorney, have been unable to reach an agreement that would resolve the lawsuit brought by Sterling Brown,

 

Whereas, The City Attorney recommends and the Common Council of the City of Milwaukee deems it most appropriate to submit an Offer of Judgment to the plaintiff, Sterling Brown, to bring this litigation to an end; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee that the City Attorney be and is hereby authorized to submit pursuant to Rule 68 of the Federal Rules of Civil Procedure an Offer of Judgment in the amount of $400,000 to pay for all damages, attorneys’ fees and costs in the case of Sterling D. Brown v. City of Milwaukee, et al., Case No. 18-C-0922
