Resolution authorizing the Commissioner of Public Works to execute Sewer Easement SE-2886 and Water Easement WE-969 in vacated East Archer Avenue between South Kinnickinnic Avenue and 166’+/- East of South Kinnickinnic Avenue, in the 14th Aldermanic District.
Body
Whereas, The City asserts its rights under Wis. Stat. Sec. 66.1005(2) to continue to hold an easement and rights incidental in and to the easement areas within the vacated ROW.
Whereas, The City may enter the vacated ROW to construct, operate, maintain, inspect, repair, enlarge, reconstruct, replace, and relocate, as the City deems necessary, the sewer, water, and related facilities within the easement area on terms and conditions negotiated by the City’s Department of Public Works, as reflected in the easement documents that have been made part of this file; now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the proper City officials, including the Commissioner of Public Works, are hereby authorized: (i) to sign Sewer and Water Easements in the form and substance submitted to this file (or in substantially the sa me form and substance as submitted, and to effectuate the intent of this resolution); and (ii) to cause the same to be recorded in the Milwaukee County Register of Deeds Office.
