Title
Resolution amending Resolution File Number 180605 to authorize funds received from the settlement of the lawsuit City of Milwaukee v. Kenneth Churchill to be used for funding Operation Impact.
Analysis
This resolution directs that funds received from the settlement of City of Milwaukee v. Kenneth Churchill, a nuisance abatement lawsuit, be used to fund Operation Impact, a local non-profit dedicated, in part, to the abatement of prostitution and related nuisances. The amount of the settlement is $15,000.
Body
Whereas, On July 31, 2018, The Common Council adopted Resolution File Number 180605, authorizing the acceptance of a settlement and receipt of $15,000 in the matter of City of Milwaukee v. Kenneth Churchill, a nuisance abatement lawsuit; and
Whereas, The settlement included a $15,000 payment to the City’s general fund for anti-drug and/or anti-prostitution initiatives in Milwaukee Police District 2; and
Whereas, Operation Impact conducts anti-drug and anti-prostitution initiatives in Milwaukee Police District 2; and
Whereas, Section 304-91 of the Milwaukee Code of Ordinances establishes procedural guidelines related to the expenditure of funds to be reimbursed by greater than anticipated revenues; and
Whereas, The City Comptroller has certified greater than anticipated revenue in the amount of $15,000, pursuant to s. 304-91,
Pursuant to s. 304-91, I hereby certify that the money required for this is anticipated to be realized on or before December 31, 2019 and to be expended only for the purpose in this resolution.

Resolved, By the Common Council of the City of Milwaukee, that Common Council Resolution File Number 180605 is amended by inserting the following “Resolved” and “Further Resolved” clauses after the last “Whereas” clause:
“Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are authorized to execute the Stipulation and Order for Dismissal attached to Common Council File Number 180605 on behalf of the City; and, be it
“Further Resolved, That the Common Council-City Clerk is authorized to accept up to $15,000 of contributions for Operation Impact for anti-drug and anti-prostitution initiatives in Milwaukee Police District 2 and to expend those funds for this purpose or any purpose specified by the contribution, no more than the amount actually received, in accordance with established City policies and procedures; and, be it
“Further Resolved, That upon receipt and deposit of these funds, the City Comptroller is authorized and directed to establish a special account within the Common Council-City Clerk’s budget for the expenditure of the contributions; and, be it
“Further Resolved, That the City Comptroller is authorized and directed to create appropriations and estimated revenue from the Special Purpose Account for Contributions, 0001-2110-D001-006300-2018, and the Estimated Revenue Account for Contributions, 0001-2110-0001-009850-2018, to the Common Council-City Clerk’s Special Account, 0001-1310-006000-DXXX-2018 and the Common Council-City Clerk’s Estimated Revenue Account, 0001-1310-0001-009850-2018, in the amount of $15,000; and, be it
“Further Resolved, That after the Common Council-City Clerk’s contribution accounts have been created, the City Comptroller is authorized and directed to transfer the $15,000 deposited in the City Attorney’s Estimated Revenue Account, 0001-1490-0001-009800-2018 into the Common Council-City Clerk’s Special Account, 0001-1310-006000-DXXX-2018 and an Estimated Revenue Account, 0001-1310-0001-009850-2018.”
