Substitute resolution conditionally approving an agreement with DNC Services Corp. and The Good Land Committee to be entered into if the City of Milwaukee is chosen by the DNC as the host city for the 2020 Democratic National Convention.
Analysis
This resolution approves an agreement with DNC Services Corp. and The Good Land Committee to be entered into only if the City of Milwaukee is selected by the Democratic Party of the United States to be the host city for the 2020 Democratic National Convention.
Body
Whereas, The City of Milwaukee is one of three finalist cities, along with Houston and Miami, to host the 2020 Democratic National Convention (the “Convention”); and
Whereas, If selected as the host city, the Convention is expected to bring approximately 50,000 visitors to the City and provide an estimated economic benefit of $200 million; and
Whereas, The Democratic Party, through DNC Services Corp., (“DNC”) is negotiating agreements with all three cities still in the running to host the Convention and each city’s host committee and expects agreements to be finalized, approved and ready to be signed by the host city and its host committee as soon as the selection is announced; and
Whereas, The Good Land Committee, Inc. (“Host Committee”) is the entity that will serve as the host committee if the City of Milwaukee is selected to host the Convention and will be responsible for, among other things, fundraising and assisting the DNC with planning and putting on the Convention -- all of which will be the subject of another agreement that the City is not party to; and
Whereas, If selected as the host city, the City will enter into the agreement attached to this file between the City, the DNC and the Host Committee regarding the City’s role in hosting the Convention (“City Agreement”); and
Whereas, Under the terms of the City Agreement, the City will be required to, among other things, assist the DNC and Host Committee with the public infrastructure needs (such as street closures) and permitting for the Convention as well providing security services as necessary for the Convention in cooperation with the DNC, federal agencies such as the Secret Service and other law enforcement and firefighting agencies; and
Whereas, Federal grants are expected to pay the costs of the security services needed for the Convention, but in the event federal grants are not available, the City Agreement requires the Host Committee to reimburse the City for such costs; and
Whereas, Because of the strict timeline for planning the Convention, the City will agree, beginning January 1, 2020, until the end of the Convention, to use binding arbitration with the DNC and Host Committee to resolve certain disputes that may arise under the City Agreement in order to avoid lengthy litigation that may interfere with the Convention; and
Whereas, The City of Milwaukee is excited to be one of three finalist cities for the Convention and looks forward to welcoming the DNC and the Convention, if selected to do so, and showcasing all that the City of Milwaukee has to offer; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the agreement attached to this file between the City, DNC Services Corp. and The Good Land Committee is conditionally approved to be entered into only if the City of Milwaukee is chosen by the DNC as the host city for the 2020 Democratic National Convention; and be it
Further Resolved, That the City Attorney is hereby authorized to enter into binding arbitration as necessary to resolve disputes that may arise under the City Agreement as further described in the City Agreement; and be it
Further Resolved, That in the event that the DNC announces that the City of Milwaukee has been selected as the location to host the 2020 Democratic National Convention, the appropriate City officials are authorized to execute the City Agreement attached to this file, with such minor modifications that may be necessary as approved by the City Attorney, and any other documents that may be necessary to carry out the City’s obligations under such agreement.
