Resolution authorizing the proper City Officers to execute Sewer Easement Releases SER-1264 and SER-2426 and Quit Claim Deeds QCD-1264 and QCD-2426 located within the southwest corner of West Morgan Avenue and South 68th Street, in the 11th Aldermanic District.
Analysis
This resolution authorizes the proper City Officers to execute Sewer Easement Releases, SER-1264 and SER-2426 and Quit Claim Deeds, QCD-1264 and QCD-2426 of sewer facilities located within the vacated portion of the southwest corner of West Morgan Avenue and South 68th Street.
Body
Whereas, In November 21, 1956 and on April 28, 1987, the City of Milwaukee was granted Sewer Easements SE-1264 and SE-2426, respectively, for access and maintenance of a 12-inch diameter storm main sewer within the vacated portion of the southwest corner of West Morgan Avenue and South 68th Street; and
Whereas, Said facilities will be relocated by and at the cost of JMC Properties LOC 120 LLC (current owner) in order to develop the lands in the south west corner of West Morgan Avenue and South 68th Street, and
Whereas, Once said facilities in Sewer Easements SE-1264 and SE-2426 are relocated, they will no longer serve the interest of the City and will be released with the sewers therein conveyed to the owner; now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to accept Sewer Easement Releases, SERs-1264 and 2426 and Quit Claim Deeds QCDs-1264 and 2426 in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); (ii) to sign the easement release and cause the same to be recorded in the Milwaukee County Register of Deeds Office.
