Title

Substitute resolution terminating Business Improvement District No. 44 (Kinnickinnic Avenue), in the 14th Aldermanic District.

Analysis

This substitute resolution terminates Business Improvement District No. 44, pursuant to Wisconsin Statutes, for the stretch of area on South Kinnickinnic Avenue bounded by East Bay Street on the north, East Morgan Avenue on the south, South Howell Avenue bounded by East Lincoln Avenue on the north and East Homer Street on the south.

Body

Whereas, Several property owners in Business Improvement District (“BID”) No. 44 have submitted a petition requesting the City of Milwaukee (“City”) to terminate the BID; and

 

Whereas, Within 30 days of filing the petition, the City Plan Commission received testimony regarding the termination of the BID at a meeting noticed by certified mail and the publication of a Class II Notice under Chapter 985 of Wisconsin State Statutes; and

 

Whereas, Following a 30-day period for property owners to add to the petition or retract their signatures, said petition has been reviewed and deemed by the City to meet Wisconsin State Statutes Section 66.1109 requirements for the termination of the BID; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that BID No. 44 shall be terminated on the date on which the obligation with the latest completion date entered into to implement BID No. 44’s Operating Plan expires and BID No. 44 provides the City with an additional independent certified audit upon termination of BID No. 44; and, be it

 

Further Resolved, That all City officials, departments, boards and commissions are directed to take all actions and provide such assistance, as needed, to carry out the intent and purpose of this resolution for the termination of BID No. 44.
