Minutes note: Mr. Tim Askin said the applicant is replacing wood windows with vinyl windows. The work has been completed so no original windows remain on the property. Staff recommends denial of the vinyl and put in wood replacement windows. William Smith - owner - 9309 W. Windwoods Dr. - he was not aware and was not advised by the previous owner. There are approximately 12 other houses that have vinyl windows. Ald. Bauman moved, seconded by Ms. Keating Kahn, for denial. There were no objections.

This resolution reverses the decision of the Historic Preservation Commission to deny a Certificate of Appropriateness for the installation of vinyl replacement windows at 4476-4482 N. 25th Street in the Garden Homes Historic District for William C. Smith.
Body
Whereas, The Historic Preservation Commission met on September 11, 2017 to review a Certificate of Appropriateness, and, by a vote of four (4) “ayes”, zero (0) “noes”, and one (1) “excused”, denied the Certificate of Appropriateness for the use of vinyl windows to replace wood windows at 4476-78 N. 25th Street, a house in the Garden Homes Historic District; and

Whereas, The owner of the property, pursuant to s.320-21-11-l of the Milwaukee Code of Ordinances, is entitled to appeal to the Common Council the Commission's decision to deny or grant with conditions on a Certificate of Appropriateness; and

Whereas, On September 21, 2017, the owner, William C. Smith, appealed the Commission’s decision to deny the Certificate of Appropriateness; and

Whereas, The Zoning, Neighborhoods and Development Committee held a hearing on October 10, 2017, and, by a vote of three (3) “ayes”, one (1) “no”, and one (1) “excused”, reversed the decision of the Historic Preservation Commission and granted the appeal for a Certificate of Appropriateness; now, therefore, be it;

Resolved, By the Common Council of the City of Milwaukee, that the appeal filed by the owner, William C. Smith, relative to a Certificate of Appropriateness is granted; and
