Analysis

This resolution amends a lease agreement with  T-Mobile Central LLC  (T-Mobile) for the placement of personal communications services antennas at the Hawley Road Water Tower at 5701 W. McKinley Ave., which was authorized by Common Council Resolution File Number 000715, adopted on September 22, 2000.

Body

Whereas, The Common Council adopted Resolution File Number 000715 on September 22, 2000, approving a 5-year lease agreement with Voicestream Wireless for the placement of personal communications services antennas at the Hawley Road Water Tower at 1235 N. 57^th St.; and

Whereas, The lease agreement with Voicestream Wireless was extended for a 5-year term authorized by resolution  File Number 050899, adopted on November 15, 2005; and

Whereas, T-Mobile Central LLC (T-Mobile) has succeeded to the interests of Voicestream Wireless as tenant in the lease; and

Whereas, The Common Council adopted Resolution File Number 110462 on November 2, 2011, approving a 5-year lease agreement with T-Mobile for the placement of personal communications services antennas at the Hawley Road Water Tower at 5701 W. McKinley.; and

Whereas, The Common Council adopted Resolution File Number 120716 on February 27, 2013, approving an amendment to the lease agreement with T-Mobile; and

Whereas, The Milwaukee Water Works working with the City Attorney's Office, has negotiated an amendment to the lease agreement; and

Whereas, This amendment of the lease agreement between the City and T-Mobile for the placement of personal communications services antennas at the Water Works facility located at 5701 W. McKinley Ave., allows T-Mobile to upgrade its; and

Whereas, The lease agreement offers a fair market value to the City, protects other City interests, and is acceptable to all City participants; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves and amends the lease agreement, identified as the "Fourth Amendment to Lease Agreement," between the City of Milwaukee and T-Mobile for the placement of personal communications services antennas at the Hawley Road Water Tower at 5701 W. McKinley Ave., a copy of which is attached to this file, and authorizes the proper City officials to enter into this lease agreement on behalf of the City of Milwaukee.
