Title

Analysis
This substitute resolution authorizes an easement for below and above ground utility facilities on City-owned property.

Body
Whereas, Wisconsin Electric Power Company, doing business as WE Energies, provides electrical service to the City-owned property at 100 West Virginia Street and surrounding properties; and

Whereas, The Department of Public Works, working with WE Energies, has requested to install a pole and guy wire with all necessary and appurtenant equipment below and above ground as deemed necessary; and

Whereas, WE Energies has requested a ten foot wide easement on City-owned property at 100 West Virginia Street (“Property”) to construct, install, operate, maintain, inspect, repair, reconstruct, and replace a pole, together with the necessary anchors, guy wires, pedestals, riser equipment and all other appurtenant equipment below and above ground which WE deems necessary to stabilize an existing pole in the public right of way (collectively called the “Facilities”), a copy of which easement is attached to this Common Council File; and

Whereas, In the event City of Milwaukee conveys, transfers, sells, or otherwise relinquishes ownership of the Property, WE Energies shall remove the Facilities at its own cost and return the area to substantially the same condition as existed previously; and

Whereas, The Department of Public Works staff has reviewed the easement and recommends approval; now, therefore, be it
