Analysis
This substitute resolution authorizes settlement of claims raised by the plaintiffs, J.M. and the Estate of Dontre Hamilton, in the lawsuit entitled J.M., et al. v. City of Milwaukee, et al., Case No. 16-CV-507, in the United States District Court for the Eastern District of Wisconsin for the total amount of $2,300,000.00
Body
Whereas, Plaintiffs filed a civil rights lawsuit against the City of Milwaukee and Police Officer Christopher E. Manney, Case No. 16-CV-507, in the United States District Court for the Eastern District of Wisconsin, and
Whereas, Plaintiffs have entered into an agreement to settle the claims raised in the lawsuit for the total amount of $2,300,000.00; and
Whereas, The City Attorney recommends that the City of Milwaukee settle this lawsuit; now, therefore be it
Resolved, By the Common Council of the City of Milwaukee that the proper city officers be and hereby are authorized and directed to issue City checks or complete electronic fund transfers totaling the amount of $2,300,000.00 payable as follows: $1,100,000.00 to Samster, Konkel & Safran, S.C. Trust Account, and $1,200,000.00 to BHG Structured Settlements, Inc., in full and final settlement of this lawsuit, upon receipt of general releases of claims approved as to form and execution by the City Attorney; said amount to be charged to Damages and Claims Account No. 0001-1490-S118-006300, and be it
Further Resolved, That the funding of the settlement amount will be authorized by a resolution contemporaneously approved by the Common Council, and that the proper City officers are authorized to make the necessary transfers to the appropriate accounts or funds to dispense the settlement amount.
