Analysis
This ordinance:

1. Adds a low-speed vehicle used for group travel service for hire to the definition of “shuttle vehicle.”

2. Replaces the term “neighborhood electric vehicle” with “low-speed vehicle,” adopting the statutory definition of “low-speed vehicle.”

Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:

Part 1. Section 100-3-14.5 of the code is created to read:

100-3 Definitions.

14.5. PASSENGER-CARRYING CAPACITY means the seating capacity of the vehicle which has been specified by the manufacturer, or established by the department of public works upon visual inspection of the vehicle.

Part 2. Section 100-3-25 of the code is repealed and recreated to read:

25. SHUTTLE VEHICLE means a privately owned vehicle which is solely engaged in the business of carrying passengers in either a:

a. Shared ride service for hire on a fixed route and fixed schedule to and from predetermined locations; or

b. Group travel service for hire, provided that the vehicle:

b-1. Operates on a pre-reserved basis only and has a passenger-carrying capacity of 5 or more persons, excluding the driver; or

b-2. Is a “low-speed vehicle,” as defined in 340.01(27h), Wis. Stats., and is titled and registered by the state as a low-speed vehicle.

Part 3. Section 101-51-0 and 1 of the code is repealed and recreated to read:

101-51. Use of Low-speed Vehicles On City Streets.

1. “Low-speed vehicle” means a motor vehicle that conforms to the definition and requirements for low-speed vehicles as adopted in the federal motor vehicle safety standards for low-speed vehicles under 49 CFR 571.3(b) and 571.500.
