Title
Resolution authorizing the Commissioner of Public Works to execute and record a Declaration of Deed Restrictions against the Parcels located at 5664 South 20th Street and at 5710 South 20th Street, in the 13th Aldermanic District.

Analysis
This original resolution authorizes the Commissioner of Public Works to execute a Declaration of Deed Restrictions against the lands within the property lines of 5664 South 20th Street and 5710 South 20th Street, with Tax Key Numbers 670-1622-000 and 670-1641-000 respectively, for the purpose of reserving the lands as a Storm Water Management Areas.

Body
Whereas, The City of Milwaukee (City) was granted a Municipal Flood Control grant from the Wisconsin Department of Natural Resources (DNR) to acquire and raze two properties located at 5664 and 5710 South 20th Street (Parcels) with Tax Key Numbers 670-1622-000 and 670-1641-000 respectively which have had repetitive flood damages; and
Whereas, The City has taken ownership of and will raze the two parcels in 2015; and
Whereas, In conformance with the grant requirements, the City has drafted a Declaration of Deed Restrictions against the properties to preserve the Parcels as stormwater management areas; and
Whereas, The Declaration of Deed Restrictions shall run with the Parcels and be incorporated with any subsequent transfers of the said Parcels, and is binding upon successors and assigns of the City; and
Whereas, The City may grant various utility easements throughout the Parcels as long as they do not conflict with the Deed Restrictions, however, no utility structure may be erected that would obstruct the stormwater flow; and

Whereas, Any changes or modifications to the Deed Restrictions must be approved in writing by the DNR Municipal Flood Control Grant Manager and filed with the Milwaukee County Register of Deeds as an amendment to this document; now, therefore, be it
