Analysis
This resolution authorizes the Commissioner of Public Works to execute a document titled an Agreement for Maintenance or other Roadside Landscaping within Milwaukee County Trunk Highway (CTH) Right of Way - Agreement No. 2015Y1 between the City of Milwaukee and Milwaukee County for the maintenance of six bioswales. The bioswales are located in the medians of East Layton Ave between South Howell Avenue and STH 794.

Body
Whereas, Stormwater pollution control is an important component of the City of Milwaukee’s (City) storm water management regulations and the City’s stormwater permit with the Wisconsin Department of Natural Resources (DNR); and

Whereas, Nonpoint sources such as roadways have been recognized as the primary source of environmental pollution by discharging polluted runoff directly into the local streams and water bodies, threatening natural habitat and species; and

Whereas, The City proposes to construct six bioswales in the medians of East Layton Avenue (CTH Y) between South Howell Avenue and STH 794; and

Whereas, Said portion of East Layton Avenue is under the jurisdiction of the Milwaukee County (County) and the project will be undertaken as part of the County’s improvement of said East Layton Avenue; and

Whereas, In order to establish the terms and conditions for the maintenance of the bioswales, the City and the County desire to enter into an Agreement, attached, hereto; and
