Body
Whereas, the RiverCrest II Equity, LLC (“Developer”) is undertaking a the redevelopment of the properties located at 2240 N. Commerce Street and 1300 E. Garfield Avenue including the construction of 46 residential apartments and a new location for Adventure Rock indoor rock climbing gymnasium, and in conjunction therewith, Developer has requested that the City of Milwaukee partially release the City’s easement rights arising under a 1990 Slope and Maintenance easement, recorded with the Milwaukee County Register of Deeds as on February 7, 1991 document no. 6455948 and
Whereas, the portion of the Easement which the Developer has requested the City release is the portion of the easement upon which the Developer will construct a new structure; and
Whereas, the City, by its Department of Public Works with assistance from the City Attorney’s Office, has reviewed the Developer’s request and negotiated the Partial Release of Easement that is part of this file to accomplish the partial release of easement; now, therefore, be it
Resolved, by the Common Council of the City of Milwaukee, that the proper City officers, including the DPW Commissioner, are hereby authorized: (i) to sign the Partial Release of Easement document affecting the City’s Slope and Maintenance Easement, in the form and substance submitted to this file (or in substantially the same form and substance as submitted, and to effectuate the intent of this resolution); and (ii...
