This resolution amends the lease agreement between the City of Milwaukee and the Board of Business Improvement District No. 2 for the Catalano Square Property located at 138 North Broadway, which was authorized by Common Council Resolution File Number 100261 adopted on July 27, 2010.
Body
Whereas, The Common Council adopted Resolution File Number 100261 on July 27, 2010, approving a lease agreement between the City of Milwaukee and the Board of Business Improvement District No. 2 for the Catalano Square Property located at 138 North Broadway ("the Lease"); and
Whereas, The legal description contained in the Lease inadvertently includes property owned by a third party abutting the Catalano Square property; and
Whereas, The owner of the property included in the legal description desires to sell its property and the inclusion of its property in the Lease legal description is causing title issues; and
Whereas, This amendment of the Lease corrects the legal description to include only that property owned by the City; now, therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Common Council approves and amends the lease agreement, identified as the "First Amendment to Catalano Square Park Lease" between the City of Milwaukee and Board of Business Improvement District No. 2 for the Catalano Square Property located at 138 North Broadway, a copy of which is attached to this file, and authorizes the proper City officials to enter into this amendment of lease agreement on behalf of the City of Milwaukee.
