Analysis
This resolution approves an Operating Agreement between the City and Milwaukee Marathon, Inc., for the staging of the inaugural Milwaukee Running Festival on October 31 and November 1, 2015. It further authorizes and directs the proper City officials to execute the Operating Agreement.

Whereas, Milwaukee Marathon, Inc., (d/b/a Milwaukee Running Festival) has proposed the staging of a large marathon, half-marathon, 5K and one-mile distance-running event within the City of Milwaukee on October 31 and November 1, 2015; and

Whereas, On November 25, 2014, the Common Council adopted File Number 141123, a resolution directing the City Attorney to prepare an operating agreement between the City and Milwaukee Marathon, Inc., for the staging of the inaugural Milwaukee Marathon (n/k/a Milwaukee Running Festival) in 2015; and

Whereas, File Number 141123 further provides that the City Attorney shall submit the draft Operating Agreement to the Common Council for its review and approval, and that the Commissioner of Public Works may execute the Operating Agreement only upon its approval by the Common Council; and

Whereas, The City Attorney’s Office has prepared the attached draft Operating Agreement and submitted it to the Common Council for its review and approval; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the attached draft Operating Agreement between Milwaukee Marathon, Inc., and the City of Milwaukee for the staging of the inaugural Milwaukee Running Festival on October 31 and November 1, 2015, is approved; and, be it

Further Resolved, That the proper City officials are authorized and directed to execute an Operating Agreement with Milwaukee Marathon, Inc....
