Resolution authorizing the Commissioner of Public Works to execute a Utility Agreement Change Order with the State of Wisconsin Department of Transportation for work on City of Milwaukee Sanitary Sewer facilities in conjunction with the Zoo Interchange's Core Phase 1 contract.
Analysis
This resolution approves the entitled Change Order for Payment for the Relocation or Replacement of Municipal Utility Facilities Located on Public Held Land Required by Freeway Construction for City of Milwaukee Sanitary Sewer facilities, and authorizes the Commissioner of Public Works to execute the Change Order on behalf of the City of Milwaukee.
This Change Order relates to utility work on City of Milwaukee Sanitary Sewer facilities necessitated by the rehabilitation of the Zoo Interchange Core Phase 1 contract work Project ID 1060-33-07/80 being undertaken by the Wisconsin Department of Transportation in 2014. This Change Order provides generally for the City to be reimbursed from the State 90 percent of the City costs for all additional work on City of Milwaukee Sanitary Sewer facilities necessitated by the freeway rehabilitation project in accord with Wisconsin State Statute 84.295(4m).

Whereas, The State of Wisconsin Department of Transportation has scheduled the reconstruction of the Zoo Interchange in the City of Milwaukee, Milwaukee County; and
Whereas, There will be work required on City of Milwaukee Sanitary Sewer facilities as a result of the design and construction associated with the Zoo Interchange freeway work; and
Whereas, Wisconsin State Statute 84.295(4m) indicates that the Wisconsin Department of Transportation will pay 90 percent of the cost of alteration, rehabilitation and relocation of municipal utilities with the responsible jurisdiction liable for the remaining 10 percent of the cost; and
Whereas, The City of Milwaukee received authority to enter into a Utility Agreement (641), with the Wisconsin Department of Transportation (Res. No. 130934), through which the Wisconsin Department of Transportation initially indicated reimbursement would be granted
Whereas, the Wisconsin Department of Transportation has requested the execution of a Utility Agreement Change Order, to the City's already-legislated Utility Agreement No. 641 (Resolution No. 130934) (Utility Project ID 1060-38-44) be undertaken and used as the vehicle through which the City of Milwaukee can be reimbursed for their costs associated with the additional work on City of Milwaukee Sanitary Sewer facilities
Whereas, The additional estimated City costs for review of City of Milwaukee Sanitary Sewer facilities alteration for Department of Public Works/ Infrastructure Services Division will be $8,000 with the City of Milwaukee 10 percent share being $800 for City of Milwaukee Sanitary Sewer facilities related to the Zoo Interchange's Core Phase 1 project State Project ID 1060-33-07/80; and
Whereas, Resolution No. 130934 has already authorized the Commissioner of Public Works to prepare and review plans and estimates as necessary to accomplish the project and City Comptroller to establish the necessary internal accounts (SM495130094/ST320125447) to track the work associated with the Zoo Interchange's Core Phase 1 utility work, for a total amount of $30,000 with a City share of $3,000;
Whereas, Resolution No. 130934 has already authorized the Commissioner of Public Works to make periodic payments and invoices as necessary to accommodate the work required for the Zoo Interchange freeway work utility alterations as required under the aforementioned Change Order; therefore, be it
Resolved, By the Common Council of the City of Milwaukee, that the Commissioner of Public Works is hereby authorized and directed to execute the Utility Agreement Change Order for the City of Milwaukee Environmental Engineering Sewer facilities, attached to this resolution by reference as though set forth in full.
Further Resolved, That the City Comptroller is authorized and directed to transfer to these amounts required under the agreement and City accounting policy, but not to exceed a 10% increase of the total amounts reserved for the grantor's share and local share or $5,000, whichever is greater, as follows:
