Title

Resolution amending the Facilities and License Agreement with Midwest Fiber Networks, LLC, relating to the construction of a citywide wireless network infrastructure.

Analysis

This resolution approves an amendment of the Facilities Use and License Agreement with Midwest Fiber Networks, LLC, that changes the deadline for construction of the citywide wireless network infrastructure demonstration area from 120 days following the effective date of the Facilities Use and License Agreement (September 18, 2006) to 120 days following March 9, 2007, the First Amendment effective date. 

Body

Whereas, Common Council File Number 050889, adopted on January 18, 2006, authorized and directed the Director of the Department of Administration, acting on behalf of the City of Milwaukee, to negotiate and enter into a Facilities Use and License Agreement with Midwest Fiber Networks, LLC; and

 

Whereas, The Facilities Use and License Agreement with Midwest Fiber Networks, LLC was effective on September 18, 2006; and

 

Whereas, The City and Midwest Fiber Networks, LLC, wish to amend the Facilities Use and License Agreement so that the deadline for construction of the citywide wireless network infrastructure demonstration area is 120 days following March 9, 2007, the First Amendment effective date.; now, therefore, be it

 

Resolved, By the Common Council of the City of Milwaukee, that the Facilities Use and License Agreement with Midwest Fiber Networks, LLC, relating to the construction of a citywide wireless network infrastructure is amended in accordance with the terms and conditions attached to this file.
