Analysis
This charter ordinance amends the reporting requirements of city officials to ensure that requisite information relating to city employes is transmitted to the Milwaukee employes' retirement system in a timely fashion.
Body
The Mayor and Common Council of the City of Milwaukee do ordain as follows:
 
Part 1.  Section 36-03-4 of the charter is amended to read:
 
36-03.      Membership.
 
4.  REPORT OF CITY OFFICIALS.  It shall be the duty of the head of each department or agency of the city government employing persons who are members or are entitled to become members to submit to the board such statements as the board shall require, of the name, title, compensation, duties, date of birth and length of service of each such person employed by such department or agency. >>Failure on the part of the head of any such department or agency to submit all information required by statement of the board, within the timeframe and in such manner and format as specified by the board from time to time, shall be a breach of that duty and the employes' retirement system may pursue all available remedies against said department or agency head, including the initiation of a lawsuit, to compel the noncompliant department or agency to comply with its reporting obligation.  The noncompliant department or agency shall be liable for all damages and expenses incurred by the employes' retirement system in securing the requisite information, including all professional and legal services rendered in preparing, formatting or obtaining such information.<<
 
Part 2.  This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within 60 days a referendum petition is filed as provided in s. 66.0101(5), Wis. Stats., in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.
