Title
Resolution authorizing and directing the proper City officers to accept a sewer easement document (SE-2606-A) from Trakloc Midwest LLC, located at 6500 West Calumet Road.
Analysis
This resolution authorizes and directs the proper City officers to accept a sewer easement (SE-2606-A), located in Trakloc Midwest LLC property at the above address. The easement runs through the northwesterly boundary line and approximately 75 feet from the northeasterly boundary line of the property.
Body
Whereas, The City of Milwaukee obtained an easement required to maintain the existing 18-inch diameter storm sewer that runs within the boundaries of Trakloc Midwest LLC property; and

Whereas, Sewer easement SE-2606-A granting permission to the City to maintain said storm sewer has been granted by Trakloc Midwest LLC, and approved as to contents, form and execution by the proper City officers; and

Whereas, Sewer easement SE-2606-A will also grant the City the right of entry in and across the property and with the right to inspect, enlarge, reconstruct and relocate as it may become applicable for said sewer; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officers are hereby authorized and directed to execute Sewer Agreement SE-2606-A, a copy of said Agreement being attached to Common Council File Number 060558 and incorporated in this resolution by reference as though set forth in full; and, be it

Further Resolved, That the authority hereby conferred upon the City officers to execute the Agreement includes the authority to make and/or negotiate future reasonable modifications that do not substantially change the intent of the agreement; and, be it

Further Resolved, That after said Agreement document has been executed by the proper City officers, it shall be forwarded to the City Attorney for approval as to form and execution and then to the Department...
