Title
Resolution establishing and funding a draw-down account with the Milwaukee County Clerk of Court for the payment of filing fees for property liens filed by the Municipal Court.
Analysis
This resolution authorizes the establishment and funding of a draw-down account with the Milwaukee County Clerk of Court for the payment of filing fees for property liens filed by the Municipal Court. The draw-down account shall not exceed $10,000, and funds required for this account shall be allocated from the annual operating budget of the Municipal Court.
Body
Whereas, The filing of a property lien is one method used to enforce municipal court judgments; and
Whereas, Current manual methods for processing and filing these liens are labor-intensive for Municipal Court and County staff, and result in significant lag times between enforcement and filing; and
Whereas, The upgrade to the Municipal Court’s new case management system has made it possible for the Municipal Court to develop a mechanism for filing these liens electronically, thereby reducing labor costs and shortening the turnaround time for filing; and
Whereas, Electronic filing of these liens immediately upon enforcement will increase the judgments and penalties collected in this manner, thereby increasing revenue to the City; and
Whereas, The Milwaukee County Clerk of Court cannot accept property lien filings without the pre-payment of filing fees; and
Whereas, The payment of filing fees using the current voucher method will significantly increase time required to file the property liens and negatively affect the collection of these judgments; and
Whereas, The Milwaukee County Clerk of Court is willing to establish a draw-down account in the City’s name for the payment of these filing fees; and
