Body
Whereas, Marquette University wants to construct an underground conduit to its new Arrupe House in order to connect it to Marquette’s fiber optic network; and

Whereas, Said underground conduit may only legally encroach into the public right-of-way by granting of a special privilege resolution adopted by the Common Council; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that Marquette University, c/o Facilities Services, 517 North 14th Street, Milwaukee, Wisconsin 53233, is hereby granted the following special privilege:

To construct and maintain a 4-inch diameter conduit under and across the 60-foot right-of-way of North 13th Street approximately 192 feet north of the northline of West Wells Street. Said conduit is to be constructed approximately 30 inches below grade.

Said above-mentioned underground conduit shall be used, kept and maintained to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.

Said underground conduit shall be maintained or removed from the public right-of-way, at such future time as they are no longer needed, to the satisfaction of the Commissioners of Public Works and Department of Neighborhood Services.

Further Resolved, That this special privilege is granted only on condition that by acceptance of this special privilege the grantee, Marquette University shall:
