Analysis
This resolution authorizes the City Officers to execute an amendment to the Intergovernmental Cooperation Agreement (Agreement), executed on December 21, 1999, between the City of Milwaukee (City), the Board of School Directors of the Milwaukee Public Schools and the Milwaukee Metropolitan Sewerage District (MMSD) regarding the stormwater detention facility located at Henry David Thoreau Elementary School. The amended Agreement establishes new terms and conditions for the operation and maintenance of the modified detention basin between City and MMSD.

Whereas, In 1999, based on consultant recommendation and to address drainage-induced flooding along Southbranch Creek in the city of Milwaukee and the village of Brown Deer, MMSD proposed to construct a dry stormwater detention facility at Henry David Thoreau Elementary School, 7878 North 60th Street; and

Whereas, Common Council File 990459 authorized the City to enter into an Intergovernmental Cooperation Agreement with the Milwaukee Metropolitan Sewerage District and the Board of School Directors of the Milwaukee Public Schools granting MMSD an easement to property of the Henry David Thoreau Elementary School; and

Whereas; The agreement also required MMSD to construct the dry detention basin at no cost to Milwaukee Public Schools or City and assigned responsibilities for maintenance of the detention facility; and
