This resolution directs the Intergovernmental Relations Division - Department of Administration to seek introduction and passage of state legislation authorizing municipalities to require payment of all outstanding parking citations before release of an impounded motor vehicle.
BODY:
Whereas, The Milwaukee Code of Ordinances authorizes release of a towed and impounded motor vehicle when the owner pays the towing and storage charges, even when outstanding parking citations for that vehicle remain unpaid, s. 101-25; and
 
Whereas, Unpaid parking citations constitute an overdue debt that the vehicle owner owes to the City and that should be paid before a towed vehicle is released to its owner; and
 
Whereas, State statutes do not expressly authorize the City of Milwaukee to retain an impounded vehicle until all outstanding parking citations for that vehicle are paid; and
 
Whereas, The City Attorney's office has taken the position that the state legislature should grant such express authority before the City enacts an ordinance to require payment of outstanding parking citations for an impounded motor vehicle; now, therefore, be it
 
Resolved, By the Common Council of the City of Milwaukee, that the Intergovernmental Relations Division - Department of Administration is directed to seek introduction and passage of state legislation expressly authorizing municipalities to require payment of outstanding parking citations attributable to an impounded motor vehicle before that vehicle is released from impoundment.
