Section 71.935, Wis. Stats., authorizes the Wisconsin Department of Revenue to set off taxpayer refunds and other refundable credits against certain debts owed to counties and municipalities. Debts owed for citations for nonmoving traffic violations are not currently included. This resolution directs the Intergovernmental Relations Division - Department of Administration to lobby in support of pending state legislation to allow setoffs for municipalities and counties against income tax refunds for unpaid and unadjudicated parking citations.
BODY:
Whereas, Section 71.935, Wis. Stats., authorizes the Wisconsin Department of Revenue to set off taxpayer refunds and other refundable credits against certain debts owed to counties and municipalities; and
Whereas, Debts owed for nonmoving traffic violations are not currently included for collection under the tax intercept program; and
Whereas, On January 29, 1997, the Common Council adopted File Number 961580, a resolution seeking introduction and passage of state legislation to include collection of debts resulting from the issuance of citations for nonmoving traffic violations under the Wisconsin Tax Refund Intercept Program; and
Whereas, State legislation is currently pending which would allow setoffs for municipalities and counties against income tax refunds for unpaid and unadjudicated parking citations; and
Whereas, The proposed change in state legislation is in accordance with one of the findings and recommendations of the City of Milwaukee's Working Group on Unpaid Parking Citations, as contained in the working group's "Report on Uncollected Parking Citations", dated May 2, 1997; now, therefore, be it
