Title

Resolution declaring City-owned parking lots surplus to municipal needs and authorizing marketing and sale of the properties to private buyers.

Analysis

This resolution authorizes the sale of City-owned Property according to the conditions in a Land Disposition Report pursuant to Sections 304-49-5 and 304-49-8, Milwaukee Code of Ordinances.

Body

Whereas, The Department of Public Works (“DPW”) has ten parking lots that are underutilized and it has decommissioned them and wishes to transfer them to the Department of City Development (“DCD”) for disposition, as summarized in a Land Disposition Report, a copy of which is attached to this Common Council File; and

Whereas, DCD and DPW have reviewed the surplus parking lots and determined that they are no longer of service to the community and should be marketed and sold to private entities wherever possible; and

Whereas, The City Plan Commission (“CPC”) has determined that the parking lots are surplus to municipal needs; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that CPC has declared said City-owned properties surplus; and, be it

Further Resolved, That the Commissioner of DCD, or designee, is authorized to execute offers, deeds, release any deed restrictions that inhibit transfer of properties and execute other legal documents on behalf of the City of Milwaukee and to close the transactions according to the terms of the Land Disposition Report; and, be it

Further Resolved, That the sale proceeds shall be credited to the DPW Parking Fund.
