100136 01.OrdinanceA substitute ordinance relating to zoning regulations for businesses that buy used jewelry or gold.

Minutes note: Ald. Terry Witkowski, co-sponsor of the file, was present. He presented the rationale for the ordinance. Atty. Mukamal questioned if secondhand gold and jewelry buyers re-sell their purchases or solely melt them down. Ald. Witkowski noted that these businesses do re-sell their purchases. Atty. Mukamal was concerned that these businesses are not really secondhand stores as they do melt down their purchases and they don't simply re-sell them. He also noted that the legislative record needs to be created to show the rational basis for the different zoning classification for these businesses - hard data and reports should be submitted to the file prior to the committee hearing. Atty. Mukamal is concerned that the definition also encompasses jewelry stores that do this as a side business, which results in a number of jewelry stores becoming non-conforming businesses. These jewelry stores may provide this service for existing customers, but aren't solely doing this as their main business. Ald. Witkowski stated that Milwaukee and Greenfield police officers testified at a Licenses Committee on June 2, 2010 as part of Council File 100121 as to the ties between these stores and crime incidents. Atty. Mukamal encouraged the sponsor to add studies to support this legislation and also consider primary versus secondary cash-for-gold sale, although the proposed legislation is legal. Atty. Mukamal moved, seconded by Mr. Richardson, to recommend approval, subject to the creation of a legislative record. There were no obections.
