Minutes note: The court reporter was sworn in. The Clerk made a matter of record that the Common Council has been enjoined from acting in the matter of Salvatore Salvo, agent for "Texture" by the Circuit Court. This matter has been remanded to the consideration of the Licenses Committee. The question was put: Have the members of the Common Council read the report and recommendations of the Licenses Committee and any objections filed in these matters? All members present indicated they had done so. Are any of the following or their counsel present and, if so, do they wish to address the Common Council? Jagdish Patel was not present. Fadi Alkhatib was present by counsel. Ald. Bohl moved that the Common Council resolve itself into a Committee of the Whole for the purpose of receiving testimony in this matter. There was no objection. Attorney Christopher appeared and addressed the Common Council Asst. City Attorney Adam Stephens appeared and addressed the Common Council. Ald. Bruce St., Milwaukee, WI 53204. She said that she felt intimidated testifying. She testified as to the disturbances such as excessive noise and drag racing caused by former patrons of the licensed premises as they leave the area at bar time between 1:15 a.m. to 2 a.m. She also testified to additional disturbances of noise, public urination, loud music, swearing, and threats made to her personally and to her property from former patrons of the licensed premises during bar time. On two occasions, she said that she was confronted and yelled at by former patrons outside who stated that they were from Texture. Ms. Kaufmann testified that her previous complaints regarding disorder and excessive noise associated with former patrons of Texture as documented by her e-mails to Alderman Witkowiak, were written as matters were observed and were true and accurate. Ald. Coggs moved to make emails sent by Ms. Kaufman (in the EBook) as part of the record. There were no objections. Lieutenant James Mac Gillis, MPD District 2. He was supoenaed to appear. He testified as to his personal observations of the March 6, 2011 incident. He said that the street where the fight took place was shut down from traffic flow. Lt. Mac Gillis also testified that Texture and other Walkers Point nightclubs had participated in a Second Police District meeting on or about April 4, 2011 and that disorder problems in the area had improved based upon better cooperation between police and the nightclubs. Ald. Zielinski moved to make the motion of objection, provided by Atty. Halbrooks, as part of the record. There were no objections. Atty. Halbrooks objected to the last year's findings, transcripts, and flyers (originals were lost). The Chair concurred that these items would not be applicable. Atty. Halbrooks objected to items #22 and 25 of the police report. The Chair denied this objection. Officer Christopher Agnew, MPD District 2, was present to answer questions made by Atty. Halbrooks regarding incidents contained in the police report. He was supoenaed to appear. Mr. Agnew stated that he observed the fight on 3/6/11. He did not know the duration of the fight and estimated ten to fifteen people were involved. He stated that he wrote a 3/14/11 PA-33 but did not witness the event firsthand. Father David Shields, Casa Romero Renewal Center, was present and delivered a public statement. He stated that Texture has not committed any violations. Ald. Zielinski moved to make a June 21, 2011 letter submitted by Father Shields as part of the record. There were no objections. Ald. Witkowiak asked the number of times Father Shields was present at his center and if he had knowledge of any complaints regarding Texture. Father Shields responded that he was present at the center three of four times out of the year and that they did receive complaints during the summer due to noise from Texture's patio. Ald. Kovac moved to make a MPD incident report dated 3/6/11 provided by Atty. Halbrooks as part of the record. There were no objections. Rueben Phillips, 8566 W. Appleton Ave., Milwaukee, WI 53225, was present. He showed video footage on June 20, 2011 showing the closing time of Texture and a lack of car flow on the intersection of 3rd St. and Bruce St. Ald. Witkowiak was present in objection. He said that there is still nuisance from the business based on the police report, neighborhood testimony, and constant disruptive activity outside. Atty. Halbrooks stated that no one from the police department and neighborhood association was present to object to the license, there were no factual proof given by the testifier on the emails made part of the record, and that the police report items were not accurate based on video footage shown. Ald. Kovac moved nonrenewal based upon items #21, 22, 23, 24, & 25 on the police report, neighborhood objection, and police department testimony. (Prevailed 3-2)
