Title

A substitute ordinance relating to multiunit solid waste collection late charges.

Analysis

The department of public works provides solid waste collection service to multiunit dwellings with 5 units or more for a charge that recovers 100% of the cost of providing the service. This ordinance establishes an interest penalty and late charge of 3% on all past due accounts each quarter. Charges that remain unpaid for 2 quarters will be deemed delinquent and will be reported to the city comptroller, along with a 10% for placement on the tax roll.

Body

The Mayor and Common Council of the City of Milwaukee do ordain as follows:

 

Part 1. Section 79-16-2-b of the code is repealed and recreated to read:

79-16. Penalty.

 2. LIEN. b. If any owner fails, omits, neglects or refuses to pay any fee assessed under s. 79-2-1-b for solid waste collection, pursuant to s. 66.0627, Wis. Stats., a special charge may be assessed against the subject property for all unpaid fees. The special charge assessed under this subsection shall consist of an interest penalty and late charge of 3% on outstanding balances and shall be charged on all past due accounts each quarter. This special charge may be waived by the department if deemed warranted by special circumstances. Charges that remain unpaid for 2 full quarters shall be deemed delinquent. The delinquent special charges and 10% penalty shall be reported to the city comptroller for placement on the tax roll.
