Title
Resolution approving a First Amendment to Grant of Easement Agreement related to Accessibility Improvements to the Riverwalk segment located on property owned by Fred Usinger, Inc., in the 4th Aldermanic District.
Analysis
This resolution authorizes the City of Milwaukee to enter into a First Amendment to Grant of Easement Agreement with Fred Usinger, Inc., and the Board of Business Improvement District No. 15.
Body
Whereas, Fred Usinger, Inc., a Wisconsin Corporation (“Grantor”), desires to grant the Board of Business Improvement District No. 15 (“Grantee”) and the City of Milwaukee (“City”) certain easement rights on and across a portion of its property to accommodate a segment of proposed Riverwalk Improvement (the “Accessibility Improvements”); and

Whereas, The proposed Accessibility Improvements will provide ADA access to an existing segment of Riverwalk as required by a Settlement Agreement dated July 6, 2006 among the United States of America, Business Improvement District No. 15, Milwaukee County and the City; and

Whereas, The Grantee and Grantor previously entered into a Grant of Easement Agreement dated December 30, 1994, and now wish to enter into a First Amendment to Grant of Easement Agreement, a copy of which is attached to this Common Council File, to provide public access to the Accessibility Improvements; and

Whereas, The City is a party to this First Amendment to evidence the City’s limited and conditional commitment to reimburse certain of Grantor’s expenses to induce the Grantor to provide the grant of easement to include the Accessibility Improvements; now, therefore, be it

Resolved, By the Common Council of the City of Milwaukee, that the proper City officials are directed to execute and enter into the First Amendment to Grant of Easement Agreement; and, be it
