Title
Substitute resolution relating to the removal of construction waste dumped on City-owned land located near the intersection of East Stewart Street and South Marina Drive.
Analysis
This resolution authorizes and directs the Department of City Development to have removed, within 90 days, all Marquette Interchange project construction waste that has been dumped at the Grand Trunk Yards site (located near the intersection of East Steward Street and South Marina Drive) by Wisconsin Department of Transportation contractors.
Body
Whereas, The Marquette Interchange reconstruction project is expected to generate about 800,000 cubic yards of construction waste; and

Whereas, Most of this waste - about 600,000 cubic yards - is being trucked to the Menomonee Valley for the Canal Street construction project and to raise the elevation of about 100 acres of vacant land; and

Whereas, Another 100,000 cubic yards is being recycled for use in the Marquette Interchange project itself; and

Whereas, The remaining 100,000 cubic yards is to be distributed to other sites throughout the City of Milwaukee, as determined by the City; and

Whereas, In early May, Wisconsin Department of Transportation contractors dumped Marquette Interchange construction waste at the Grand Trunk Yards, a City-owned former railroad yard located near the corner of East Stewart Street and South Marina Drive; and

Whereas, This dumping activity occurred before the City secured the necessary erosion-control permit from the Wisconsin Department of Natural Resources and before the City obtained the required special use permit from the Board of Zoning Appeals; and

Whereas, Because of their proximity to a remnant wetland and to a residential neighborhood, the Grand Trunk Yards are not an appropriate site for the dumping of construction waste; now, therefore, be it
