Analysis
This substitute resolution authorizes an easement for an existing underground pipe line on City-owned property.
Body
Whereas, In June 1961, the City of Milwaukee (“City”) granted to West Shore Pipe Line Company a 10-foot wide pipe line easement along the east property line at a former City landfill at 1600 East College Avenue that transmitted petroleum products to Mitchell Airport, but the easement has expired; and

Whereas, West Shore no longer transmits petroleum products through the pipe line and intends to convey the pipe line to the Milwaukee Metropolitan Sewerage District (“MMSD”) for a Landfill Gas Pipe Line from East College Avenue to Jones Island; and

Whereas, The pipe line is located under the portion of the property that is leased to the United States of America for access to the 128th Air National Guard facility at Mitchell Field, but the 128th Air National Guard has indicated its consent to a new easement with MMSD; and

Whereas, MMSD has requested that the City grant it a new 15-foot wide permanent easement at 1600 East College Avenue for the use of and access to the existing pipe line as illustrated on a map and plat, a copy of which is attached to this Common Council File; and

Whereas, The City Attorney and MMSD staff have completed negotiation of the terms of easement, a draft of which is attached to this Common Council File; and

Whereas, The City shall not require compensation for the easement due to the public benefits provided by reusing landfill gas; now, therefore, be it
